RIPLEY – Following a brief hearing Friday morning, Tippah County Circuit Judge Kelly Luther refused to throw out the conviction or order a new trial for a man convicted of first degree murder in late March.

The defense attorney for John McNeil listed five points from Spence’s second capital murder trial as reasons his client deserved a judgment not withstanding the verdict or a new trial. Among those arguments were testimony about a license plate reader was hearsay, the state should not have included the lesser charge of first degree murder as well as issues brought up during the state’s closing arguments.
